전 처음받은 2년짜리 그린카드(cr1)에 이름 오타(미들네임 이슈)가 있어 i90를 접수하면서 그린카드를 반납했습니다. 지금은 i751을 접수한 상태이구요.
그런데 얼마전 이런 i90 denial letter을 받았어요.
USCIS has determined
that you are ineligible to be issued a replacement Form I-551, Lawful Permanent Resident Card.
Accordingly, USCIS must deny your Form I-90.
USCIS records show that you were granted conditional permanent resident status on December 9,
2020, through a qualifying marriage to a U.S. citizen or lawful permanent resident. Individuals who
are granted conditional resident status through marriage, must file Form I-751, Petition to Remove the
Conditions on Residence, to petition for the removal of those conditions. See 8 CFR 216.4. Filing of
Form I-751 serves to extend conditional permanent resident status, and approval of Form I-751 results
in the creation of a new Form I-551, Permanent Resident Card.
On October 14, 2022, you filed Form I-751. Your Form I-751 is currently pending with USCIS. Since
the conditions on your permanent residence have not been removed, you are not eligible to receive a
replacement Permanent Resident Card. See 8 CF 264.5(d).
USCIS will send you a Permanent Resident Card if your Form I-751 is approved. Your expired
conditional Permanent Resident Card along with your I-797 Receipt Notice for Form I-751 serves as
proof of your conditional permanent resident status, until a decision is made on your Form I-751.
대충보니 전 애초에 임시영주권이였기 때문에 i90를 신청할 자격이 안됐다고 말하는거같은데..(제가 이해한게 맞는지요?)
전 i90 바이오매트릭스 다시 찍으러오라해서 갔다오고 그랬거든요. 그래서 좀 이해가 안가요.
1. 애초에 임시영주권자는 그린카드에 오타가 있어도 i90를 접수하면 안되는거였던건가요? 이럴거면 그냥 그 그린카드로 살다가 영구영주권 신청할때 이름 정정할걸 후회가 되네요 ㅠㅠ
2. 저 i90 거절된것이 지금 제 신분이나 영구영주권 진행에 문제가 되는지?
3. 반납한 제 그린카드는 이민국에서 폐기한것으로 알고있습니다. 그럼 전 영구영주권받을때가지 그린카드없이 살아야하는건가요? 뭐 방법이없나요?
4. 이번에 급하게 한국을 좀 가야하는데, 그린카드없이 i751을 신청하면서 받은 2년 짜리 연장레터만 가지고 출국해도 미국에 입국할때 문제가 없을까요? i551스탬프를 받으려했는데 예약콜이 자꾸만 안와서요..
