Q. E2 Employee 고용주 변경후 출입국

안녕하세요,

한국 미 대사관에서 받은 E2 Employee Visa로 입국하여, 미국 현지에서 고용주 변경하여 현재 E2 Employee로 미국에 거주중입니다.

대사관에서 받은 VISA의 만료기간이 남아 있고, 이민국 통하여 고용주를 변경한 상태(I-797 Approval)인데, 이때 해외 출입국에 대한 문의를 드리고 싶습니다.

찾아보니 하기와 같은 문구가 있던데요,

Sec. 214.2(e) Treaty Traders and Investors (8)

(vi) Approval . If an application to change the terms and conditions of E status or employment is approved, the Service shall notify the applicant on Form I-797. An extension of stay in nonimmigrant E classification may be granted for the validity of the approved application. The alien is not authorized to begin the new employment until the application is approved. Employment is authorized only for the period of time the alien remains in the United States. If the alien subsequently departs from the United
States, readmission in E classification may be authorized where the alien presents his or her unexpired E visa together with the Form I-797, Approval Notice, indicating Service approval of a change of employer or of a change in the substantive terms or conditions of treaty status or employment in E classification, or, in accordance with 22 CFR 41.112(d) , where the alien is applying for readmission after an absence not exceeding 30 days solely in contiguous territory.

이 경우, 고용주 변경한 당사자 및 그 Dependent 들도 해외 출국 및 재 입국이 가능하다는 것으로 이해해도 되는지요?

그렇습니다. 최초 E-2비자를 받았을 시의 고용주와 현재 새롭게 I-797 승인을 받았을 때의 고용주가 다르더라도 기존의 E-2비자의 만료일이 남아 있으면 I-797상의 고용승인기간 내에는 미국에 재입국이 가능하며 주신청자 본인 및 동반가족의 경우도 재입국이 가능합니다.
