The relevant date is the conviction date and not the arrest date for previous convictions. However, as to the current arrest, it is the arrest date. From what you wrote, I cannot determine whether you were again arrested in 2009. If you were arrested in 2009, it would depend on when in 2009. Since the 1996 will not count, you have the 1999, 2000, and 2002, and 2009. Hence, the 2009 will either be your third or fourth arrest. However, your dates are unclear since you wrote 1996, 1999, 2000, 2002 and implied 2009.
