Q. How long will it take?

Sorry, when trouble comes, they come all together. Suddenly, my computer does not allow me writing in Hangeul. My hudsband got summon for the default on credit card a while ago and we will submit response tomorrow. I know we will get judgment for 8200 plus blah blah blahs. My question is how long will it take from the openning of the process to the actual start of various recovery actions by the creditor , in this case a collection agency, in Orange County. We need to visit Korea for a while and already have plenty of other marital, financial and legal issues.

Currently my hudsband is unemployed and I am working at some company. Can they garnish my wage ? And take over joint account. If that is the case, divorce or legal seperation should be an option for me. I'm tired, tired, and tired of his childish and irresponsible behaviours. Those are not a good example for kids either.

Whenever I wrote here, alway it gets longer than I intended. I'm sorry for that. But somehow I'm just venting. Thanks for reading and I really need good advice and reliable and affordable legal counsel. Thanks.

If you file an answer and maintain
the lawsuit, you will most likely have about one year before the case goes to trial. If the debt is joint, filin a divorce won't help you. If it's just for him, divorce may help but not joint bank accounts.

I'm pretty sure you are waiting for a professional legal advices but let me tell you what I think. I think as long as your husband's credit card doesn't have joint acct with you, I don't think they can garnish your wage. But if your name is on the credit card, yes, they may pursue a some kind of legal judgment against you.
