Q. J2->F1 신분변경 추가서류 요청

안녕하세요.

저와 두 아들은 J1 남편의 J2 dependent로 있다가 지난 9월말에 F1비자로 바꾸기 위해 Form I-539를 USCIS로 보냈었습니다.

오늘 (1/16) 추가서류를 요청하는 편지를 받았습니다. 그내용이 다소 모호하여 변호사님께 질문드립니다. 제가 이해하기로는 I-539를 보낼 당시에 제 남편이 유효한 J1 status를 유지하고 있었음을 증명하기 위해 그때를 기준으로 그 이전 3개월치 pay stub을 보내라는 듯 합니다. (원문 내용은 아래에)

남편은 2016년 1월 9일까지 univ of Washington에서 exchange scholar로 있었고 지금 떠날 준비중입니다. 그런데 남편은 J1 host institution 인 U of W로부터는 급여를 받지 않았고, 한국의 직장인 대학으로 부터 안식년으로 급여를 받아왔습니다. 그렇다면 한국학교의 월급명세서를 제출해야하는 것인지요? 그것이 J1-status를 유지하고 있었다는 증거가 될까요?

만약 제가 잘못 이해했다면 어떤 서류를 제출해야하는지 알려주시기 부탁드립니다.

Form I-539

J-1 Form DS-2019: Submitted a photocopy of the principal's Student and Exchange Visitor Information System (SEVIS) Certificate of Eligibility for Exchange Visitor (J-1) Status (Form DS-2019) for an exchange visitor program.

J-2 to F-1 Maintenance of Status: The Form I-539 application seeks to change your nonimmigrant status from J-2 dependent to F-1 academic student. Before a change of nonimmigrant status may be granted, it must be demonstrated that your principal J-1 spouse was maintaining a valid J-1 status at the time application was filed. Submit at least three pay stubs that are dated prior to the filing of the I-539 to establish that the principal J-1 has maintained status.

The above information is required because the F-1 nonimmigrant status the applicant is seeking is derived from the principal's J-1 nonimmigrant status.

안녕하세요

본인께서 남편분의 J1 비자의 동반가족이므로, 남편분의 유효한 J1 상태를 확인하기 위해서 신분변경 신청 3개월전의 Paystub응 요구하는 것으로 사료됩니다.

다만 본문에서 말씀하신대로 남편분께서 한국에서 Exchange Scholar 로 오셨고, 월급을 한국에서 받으셨다면, 해당 관련 사유와 함께 월급내역서를 제출하셔야 하실듯 사료됩니다.
