Q. 영주권 거절후 motion to reopen

영주권이 거절 되었는데 motion to reopen 을 할 수 있다고
합니다. 절박한 심정에서 거기에 매달릴 수 밖에 없는데 얼마나
시간이 걸리고 그 가능성은 사안에 따라서 다르겠지만 어떤지
궁금합니다.

Motion to Reopen의 심사기간에 대한 이민국의 내부방침은 60일내 결정하는 것입니다. 그러나 일반적으로 3개월 전후하여 결과를 받습니다. 이에 대한 심사가 원결정을 하였던 부서에서 이루어지기 때문에 번복되는 경우가 흔치 않으니, 감안하여 계획을 세우십시오.

When you file Motion to Reopen, it is first reviewed by the service center that denied your case. Since you are in California, Nebraska Service Center will review your case. It could take 1-2 months or it could be longer.

If you also request appeal along with Motion to Reopen, if the Nebraska Service Center does not reverse the denial, it will forward the file to Administrative Appeals Office (AAO) in Washington, DC area. As such, you may also want to request Appeal along with Motion to Reopen so that if the Nebraska Service Center does not approve your case, it will be forwarded to AAO.
