The maximum amount you can recover in small claims in California is $10,000. As such, if you have a $40,000 claim, you can only recover $10,000 even if you win. If you want to recover your full value, you must sue in unlimited jurisdiction in the superior court. You will probably need an attorney as well as the rules are difficult to understand for lay person.
