Its of horrible story. You need to present evidence in small claims court. So you need to take the contract and proof of your payment and tell the judge that the contractor did nothing. Make sure you take someone who speaks English if you don't.
Also, make sure you follow up with the police. That person should be arrested for assault and battery and spend some time in jail. If he is convicted, the court could order restitution, that is payment to you for your damage.
Finally, you can also file a complaint with the California State Contractor's Board, their website is "cslb.ca.gov" You can also claim damages through that person's bond which he/she is required to post to maintain his license.
