Q. 세입자가 보낸 가짜 영수증

세입자가 월 랜트비가 늦어 통화 하던 중 주소가 잘 못 적어져 다시 돌아 왔다며 보일러가 고장 났다며 말 하였어요. 세입자 남편이 세탁장비 일 을 하여 기술이 좋아 고장난것이 있으면 도치며 살기로 하였어요. 계약시 세입자분들은 뱅크럽 된 상태고 저고 큰 수술을 한 상태고 서로 감사 하며 계약 하였지요.
보일러를 고치고 컴펌 없이 차액을 뻬고 랜트비용을 보냈어요.
영수증에 적힌 전화번호에 전화 하니 자기네 들은 세탁장비 회사로 그런일 은 하지 않았고 영수증도 발행 한적이 없데요. 세입자에게 전화 하니 연락도,메시지도 아무 답이 없어요. 6월 말 계약이 끝 납니다. 이럴 경우 어찌 하여야 하나요.
3년 랜트를 furnished된 상태로 주었어요. 디파짓 머니 2달치를 주었으니 3년치 이자를 주고 나머지 2달은 랜트비를 내지 않겠다고도 하였어요.

The tenant cannot offset rent from security deposit. As such, you do not have to comply with their demand. For now, it doesn't appear as though the tenants are in breach. When the time comes where they do not pay you rent and demand that you deduct the rent from their security deposit, you need to notify them in writing that security deposit cannot be used to deduct rent. Security deposit is just that, security deposit, in case of damage or for cleaing after move out. If they don't pay, then you need to immediately give them a 3day notice to pay or quit and if they still don't pay, you need to sue them. Keep in mind, however, if you are in a rent control district, it is very difficult to sue and win due to many different regulations. If that is the case for you, you may just want to negotiate rather than to sue.

Also, tenants are not entitled to interest on the security deposit unless specifically stated in the lease agreement.

도대체 2개월 디파짓이 얼마길래 3년치 이자로 2달치 렌트비로 제하자는 거죠? 상식적으로 생각해봐도 말이 안되는 것 같네요. 만약 렌트비를 안주는 것을 대비해서 세입자 eviction 에 대해 공부해놓는 것도 좋을듯 합니다. 그리고 보일러는 나중을 위해 증거로 보관하시는게 좋을듯합니다.
