Q. 조건부 영주권 해지 신청 서류 I -751

안녕하세요. 현재 필요 서류들을 혼자 준비 중입니다.

첨부 서류 중 Birth Certificate 나 social security card 카피는 필요없는지요?

처음에 영주권 신청 할때는 가족관계 증명서와 Birth certificates 를 제출하였던 것 같은데,

instruction을 봐도 없는 것 같아서 법률 전문가님들께 재차 확인하고 싶어서 질문올립니다.

그리고 tax return 최근 1년으로 족한지 하니면 조건부 영주권 받은후2년간 tax returns 를 제출해야 하는지요?

아래는 제가 작성한 Cover 입니다.

The following documents are attached:
1. Form I-751 (Petition to Remove Conditions on Residence) and list of all addresses and dates;
2. Copy of applicant's Permanent Resident Card;
3. Copy of applicant's passport; and petitioner's passport;
4. Copy of applicant's driver's license; and petitioner's driver's license;
5. Copy of the couple's marriage certificate;
6. EVIDENCE of valid marriage;
a. Joint income tax returns;
b. Apartment lease agreements indicating joint accupancy;
c. Bank statements from joint savings and checking accounts;
d. Auto insurance showing both spouses as carriers and owners;
e. Credit cards, medical cards that name the spouse as a member or beneficiary, and evidence of life insurance policies where the spouse is named as beneficiary;
f. Evidence of correspondence between the parties, including letters, birthday and holiday cards, and other correspondence addressed to the parties;
g. Evidence of vacations taken together, including airline tickets and hotel bills; and
h. Photographs of both spouses
7. Affidavits sworn to or affirmed by two people who have known both spouses since applicant's conditional residence was granted and have knowledge of the couple's marriage and relationship; and
8. Filling fees.



혹시 필요한 서류가 더 있으면 조언 부탁드립니다.

조건부 영주권의 조건(2년 유효기간)을 해제 해 달라는 서류를 접수할 때 중요한 점은 임시영주권 승인 후 여전히 부부로서 정상적인 결혼생활을 유지했는지의 여부에 관한 각종 근거서류 들 입니다.

질문자가 준비한 여러가지 서류들이 다 같이 두 분의 사실적인 결혼생활을 입증할 수 있는 중요한 서류들입니다. 많은 서류들을 준비하시는라 애 많이 쓰셨습니다. 한가지 조언을 드린다면, 출생증명서는 이미 처음 영주권신청 시 다 제출하였기에 더 이상 신경쓰지 않아도 됩니다. 소셜카드 번호는 두 분의 세금보고서 상에 이미 기재되어 있기에 사본을 보내실 필요는 없습니다.

준비하신 서류 중 빠진 서류를 지적해 드린다면,
1. 두 분이 거주하신 주소로 두 분의 명의로 발행 된 Utility Bills (물세, 전기/개스비 청구서)을 확인하시어 제출하시기 바랍니다.
2. 두 분이 사용한 전화비(가정용/핸드폰) 청구서도 첨부하십시오.
3. 신청자의 여권용 칼라사진 2매도 첨부하십시오.

구슬을 꿰듯이 준비된 서류들을 잘 정리하시어 심사관이 두 분의 결혼생활에 대하여 정상적이고 사실적밈을 확인 할 수 있도록 제출하십시오.
