If you have a written agreement for the loan, it is four years from the date of breach of the agreement. If only verbal, its two years from the date of breach. For example, if you lent money verbal with the check as proof of the loan on 1/1/2011 and the loan was supposed to be paid back on 1/1/2012, and the borrower doesn't pay, then you have until 12/31/2013.
