Q. dismissed misdemeanor(battery-domestic violence)관련 질문있습니다.

My husband recently was arrested and went to jail for 12 hours and the case was dismissed. If he expunge or seal his dismissed case,can hospital employers still see it? What do you recommend him to do to be able to work in medical field ? Thank you.

First, you need to make sure that the case was dismissed. There is a difference between dismissed cases and rejected cases. If the case was filed and later dismissed, you can have it expunged and you do not have to disclose that to any private party. However, government entities will know, so you have to disclose it to governmental agencies such as INS, FBI, police, IRS, etc.

If the case was a reject, then you can also try and expunge the arrest record which is lot harder to do.

행패 또는 폭언은 기록이 남습니다. 재 발생 않도록 최선을 다 하십시오, 가정 파괴는 어린
애들한테 평생 상처와 불신을 줍니다. 나쁜 기록도 문제 발생시 전과로 간주합니다. 감사.
