저는 community clinic 에서 일하는 데 최근에 업무스케줄을 바꾸겠다고 하면서 무조건 사인을 하라고 해서 이것이 법에 저촉되지 않는 지 묻고 싶습니다. 런치와 휴식을 자기가 선택할 수 있는지 알고 싶습니다. 제가 알기로는 점심 30분에 오전에 휴식 15분, 오후에 휴식 15분을 하던지 아니면 점심시간에 한시간을 쉬던지 선택할 수 있다고 들었는데, 우리는 다음과 같이 무조건 하겠다고 합니다.
스케줄이 정해지면 반드시 이대로만 하라고 합니다. 10시 7시 스케줄이 되면 점심을 오후 2시 30분넘어서 먹어야 해서 부담이 됩니다. 전문가나 변호사님의 답변을 원합니다.
다음 내용이 사인을 하라고 하는 내용입니다.
REST & LUNCH BREAK STAFF SCHEDULE
All non-exempt employees who work at least 3.5 hours in a work day are entitled to 10 minutes of paid,
uninterrupted, and duty-free rest period(s) for each four-hour work period or any major fraction thereof.
The number of 10-minute rest periods a non-exempt employee is entitled to is based on the number of
hours actually worked in a work day as outlined in the table below. Rest periods should be taken as close
to the middle of each four-hour work period as is practicable. THE REST AND LUNCH BREAKS ARE
MANDATORY.
WEEKDAYS
IF YOUR 8-HOUR SHIFT STARTS AT 9 AM, PLEASE TAKE A 10-MINUTE REST BREAK BETWEEN 11 AM AND
11:30 AM AND ANOTHER 10-MINUTE BREAK BETWEEN 4 PM AND 4:30 PM. YOUR 1-HOUR LUNCH BREAK
SHOULD BEGIN AT 12:30 PM.
IF YOUR 8-HOUR SHIFT STARTS AT 9:30 AM, PLEASE TAKE A 10-MINUTE REST BREAK BETWEEN 11:30 AM
AND NOON AND ANOTHER 10-MINUTE BREAK BETWEEN 4:30 PM AND 5 PM. YOUR 1-HOUR LUNCH
BREAK SHOULD BEGIN AT 1:30 PM.

IF YOUR 5-HOUR SHIFT STARTS AT 9 AM, PLEASE TAKE A 10-MINUTE REST BREAK BETWEEN 11 AM AND
11:30 AM. THERE IS NO LUNCH BREAK.
IF YOUR 5-HOUR SHIFT STARTS AT 10 AM, PLEASE TAKE A 10-MINUTE REST BREAK BETWEEN NOON AND
12:30 AM. THERE IS NO LUNCH BREAK.
Any deviation from the work schedule above must have advance approval by your supervisor or COO. If
rest or meal breaks are not observed without permission, there will be disciplinary actions.
