Whether your son is innocent or not, he has been charged with two counts. First is DUI and the second is driver without a license. If his alcohol level was only .07 or .04, then he should be able to get a dismissal or wet reckless driving. As to the driver's license, if he had a valid out of state license, he should be able to get a dismissal. However, please note that an out of state license must be replaced at least within 30 days from coming to California.
Because the above charges are misdemeanors, if he hires a private attorney, they can go to court for him and he doesn't have to go to court.
