So what you are saying is that as long as I didn't sign Buyer Exclusive Agreement, I am free from any liabilities for the previous agent? Other words, previous agent is not entitle to commission on the same property I am resubmitting the offer on? Although, contract was cancelled after escrow was opened? No. It depends on several other factors. First, my opinion in based on California law and not any other States. Second, if you had an agreement, even if not an exclusive, to pay him a comission, then you are stuck. However, if there was no agreement whatsoever, buyer's agent is out of luck and you can hire another person. Hope this helps.
