변호사 님들 수고 많으십니다.

During my college years in 2005 - 2009, I have been on and off some part time jobs. They paid me checks with required amount of tax withheld. I was young and stupid, and I have not filed tax returns for a couple years. Also, in 2010, I was on a full time job, but in early 2011, I left for Korea, and forgot to file the tax return for 2010 again.

Now I am on the process of late filing tax returns for all of those missing years. No tax is due since I was owed tax refund for every year.

I am planning to file my N-400 as soon as I am done filing all my tax returns. In that case, do I have to answer "yes" to "Have you ever failed to file a required tax return" since technically, I did file them although late?

If I have to answer "yes", the instruction states I have to attach according "correspondence with IRS" with my N-400. What does that mean by the "correspondence"?

What would all these mean in terms of my chance of my N-400 application being accepted?

표현하기에 영어가 좀더 편하여 영어로 문의드리는 점 양해 바랍니다. 감사드리며 변호사 님의 좋은 답변 부탁드리겠습니다.

Correspondence does not mean any letter or notice from the IRS. Your late filings for the past years are your correspondence on your tax retrun with IRS.

If you have already mailed such late returns, please say "NO" on that question, however, I would advise you to bring such late returns on Naturalization interview, and in the event that the adjudicator inquires about those correspondences on your late return, show him/her such documents.

As long as you took any action regarding your late tax return, it will not affect your N-400 application. It means you will be processed further for other questions or other requirementto be considered to decide your petiton for N-400 to be approved.
