Q. 미국내 교통사고가 있었습니다.

보행자교통사고를 당한뒤 급히 한국으로 귀국하게 되었는데요, 선임한 변호사 사무실측에서 운전자측 보상금 및 보험처리를 맡기로 한 상황에서, 우편상으로 필요한 싸인과 구비서류절차를 밟고 기다리고 있었는데요, 변호사사무실분이 가해자운전자측 보험사에서 합의서도 보내지 않고 달랑 합의금만 보내왔다고 하면서 사무실에 도착한 check를 한국으로 보내주겠다고 했습니다. 이런일이 처음인데다 제 서명하나도 없이 어떻게 교통사고 합의가 진행되는것인지 이해가 가지않아 여쭤보게 되었습니다. 이런 경우도 있을수 있는 건가요?

It is rare tha the other party's insurance company would just sent a settlement check without first settling the case with your attorney. Many time, the attorney obtains consent from the client to settle the case on behalf of the client so that the client does not need to sign a separate authorization to settle. You may have done just that. See your agreement with your attorney. Also, if you did not sign a written release to release the other party from any liability, you don't have to accept the check. You can return it and demand more or sue. Of course, you are in Korea now so that would be very difficult to do.
