The "judicial foreclosure" process is found in §726 of the Code of Civil Procedure.
사법 포클로져 절차는 민사 소송법 § 726에 있습니다.
“(a) There can be but one form of action for the recovery of any debt or the enforcement of any right secured by mortgage upon real property or an estate for years therein, which action shall be in accordance with the provisions of this chapter. In the action the court may, by its judgment (foreclosure decree) direct the sale of the encumbered real property . . . “
소송에서 법원은 판결에 의해 저당된 부동산(secured by mortgage upon real property) 의 판매를 지시 할 수 있습니다.
“Code of Civil Procedure §726 is referred to as the ‘one action rule,’ and the ‘security first rule.’
It provides that, where there is a debt secured by real estate, there may only be one form of action to collect the debt, and that remedy is foreclosure.”
부동산으로 담보된 부채 (loan debt)가 있는 경우, 부채를 징수하는 한 가지 형태의 그 조치는 주택 압류 및 경매 (foreclosure) 입니다.
