Q. 오바마 employer appeal

조그만 Deli 업소를 운영하고 있습니다
(직원은 full time 5 명 정도 , part time 9 명 정도고요) -
요일 별로 번걸아서 모 3 ~ 4 시간 근무하는 part time
(오바마 혜택 받는 직원 없고요)

1. 2016 년 8 월 경 Market Place 로 부터 - letter 를 받았습니다
내용은 - 홍길동이라는 직원이 Appeal을 하였는데 오바마 care 혜택을
못 받았다 - appeal 을 하고 싶으면 증빙을 보내라
(아마도 2016 년도 초에 보험 신청 하면서 - 그렇게 썻는지 추측 되고요)

2. 종업원이 50 인 이하므로 - 모든 증빙(tax report, workers comensationi
보험 , employee tax 관련 서류 등) 다 갗추어서 form에 맟추어서
affordable care act 에 의거,we're not required to offer,because our
employee is below 50 persons....... appeal 하였습니다

그리고 이 직원은 더구나 12/30/2015 에 일을 관두었다 이렇게요

3. 편지가 오기를 - 우리는 그러한 것을 판단할 authority 가 없다
우리는 오직 Offfer를 했냐 안했냐의 appeal에 관한 것만 받는다
그런 것은 IRS 에서 판단한다 - 그러므로 dismiss 할 것이다
다시 appeal 하려면 다시 해라 - 이렇게요

4. 잊어 먹고 있었는데 - HEALTH INSURANCE market place 에서 1/ 31/2017 에
편지가 와서 - Your appeal was dismissed because :

You requested an appeal of an issue that we don't have authority to
review . we have authority to review only the following issues

- did you offer health coverage to the employee that the minimum value
standard ? Health plan meets the minimum value standard if it's designed to pay at least 60 % of the total cost of medical services for a standard population and if its benefits include substancial coverage of inpatient hospital and physician services~~~~

5. 다시 appeal 을 하고 싶으면 - 다음의 RE-OPEN Form 에
다른 사유를 써서 appeal center 로 보내라

어떻게 해야 할지 당황 스럽습니다
조그만 근처 가게에서도 다 오바마 제공 안하고요

50 인이하라서 당연히 안하였습니다
Affordable care act 에도 - 50 인 이하는 not required 라고 나오는데
어떻게 해야 되는 건지
도와 주시면 무척이나 감사하겠습니다
