안녕하세요, Contractor 회사에서 일을하는데요.
손님집의 변기에서 sewage 가 backup 해서 집안에 있는 모든물건들을 다 세척, 포장하고 이동해주는일을 했는데, 직원하나가
냉장고에 있던 약들(pills)을 실온에 꺼내놨네요...
그 약은 온도에 민감해서 냉장고에 있어야하는 약들이라는데
그렇게 1주일정도가 지나버렸습니다...
그런데 손님이 약 한통에 $1000 정도 된다고 하더라구요... 알아보니 그정도는아니지만 전부합쳐서 $2000~2500 정도 됩니다...
이 주인은 장애인이고 가난하게 살아 절대 저돈을 다 낸게 아니라, 정부에서 다 지원을 해줘서 거의 공짜로 받은약들이고... 날짜보니 유통기한은 다가오는데 먹지도 않고.. 그냥 버리는약이었는데도 불구하고
마치 기회다! 싶어서 저희에게 regular price, few thousand dollars 를 돈으로 물어내라고 합니다
당연히 저희 잘못 이었기는한데, 저 약을 새로 구하려고해도 정부 지원으로 돈을 조금만 주고도 구할 수 있는 사람이거든요...
저희 contract form 에 보면 이렇게 적혀있습니다

There will be employees and subcontractors working in this property. Please remove any and all items of value, whether
monetary or sentimental, from these premises before work begins.
회사이름 takes pictures of each items, cover, mask, pack, box and move if necessary but will not be held
responsible for any lost or stolen item such as but not limited to jewelry, cash, furs, fine washables, checks, and any and all
valuable personal items of any type that you are concerned. Please list in the notes section below any valuables or contents
that require special handling, are fragile, or high value larger items; and lable fragile items with a sign saying “Fragile”By
signing this contract, Customer understands and agrees to the terms above and takes full responsibility for any valuables,
which were not removed in accordance with this notice. Customer certifies that items have been removed from the premises
listed above and that any items requiring special care have been listed below in the notes section with instructions. 회사이름 will not be held liable for damage to any such items where due diligence was used in handling. 회사이름 will take every precautionary measure to remove these items with care, but 회사이름 cannot be
held responsible for any damage that may occur. Areas may become very heated. Please remove any items that may be
affected by high temperatures, such as but not limited to candles or heat sensitive electronics. Customer must be present for
any special care removals performed by 회사이름 of any items listed below and any labeled fragile items.

이렇게 계약서에 적혀있고 손님이 사인을 했습니다... 물론 손님이 사인을하면서 특별히 다루어져야 하는 list에 아무것도 적지 않았구요
저희는 저희잘못도있기에 negotiation 하고 좋게좋게 넘어가고 싶은데 그렇게 두질 않네요.. 막무가내입니다...
만약 법정싸움이 된다면 small claim이 될것 같긴한데...
법정싸움에서 이 contract 를 갖고서 어떤식으로 판단이 될지 감조차 잡히지 않아서 질문드립니다...
contract에 따르면 우리가 아무 책임을 지지 않는걸로 나와있지만 실제 판결이 그리 난다 하더라도 어느정도 보상(몇백달러)을 해주려하는데요.. 자기 돈주고 사지도 않은것들을, 그리고 쓰지도 않는 것들을 regular price로 보상 하라는걸 보니 너무 얄밉네요..
