노준건님, 답변이 잘못된 부분이 있어서 정정해드리겠습니다. 제가 미군 전역자로 정확히 답변드리겠습니다.. 타주에 거주해도 원래 거주주의 레지던트가 아니라, 정확히 하셔야 하는게 세금보고를 어디로 했는지가 중요합니다. 예를들어 CA 거주하면서 세금보고하닥 군입대한다음 Duty Station 으로 배정받고, Finance 프리핑을 받게되는데 이때 선택권이 주어집니다. 세금보고할 State 를 어디로 할꺼냐고 서류 작성을 하게됩니다. 만약 군인배우자분이 아무것도 모르고 그냥 싸인하고 군복무지역의 주로 세금보고를 하게되었다면 CA 레지던트가 아니게 됩니다. 원래 거주했다고 그 지역 거주자로 되는게 아닙니다. 결론, 군인 배우자께서 처음에 서류 작성하고 싸인해서 제출한적 있는지 물어보시면 정확합니다. 만약 아무럿도 안했다면 지금 현재 텍스보고하고 있는 곳이 본인의 레지던트입니다. 이게 정확한 답입니다. 참고로 모두 주는 아니지만, 일부주에서 군복무자 가족에 대하여 해당주 레지던트가 아니더라도 In-state tuition 적용해주는 옵션이 있습니다 . 자녀가 입학할려는 학교에 정확히 문의하시기 바랍니다.

아니면 군인배우자 분께 LES 뽑아 달라하세요. 거기에 세금보고 하고 있는 주가 어딘지 나옵니다. LES 라고 하면 뭔지 아실것입니다.

The Higher Education Opportunity Act of 2008 provides any student (undergraduate, graduate, or professional) who is a member of the Armed Forces of the United States on active duty for a period of more than 30 days and whose domicile or permanent duty station is in California, or the spouse, registered domestic partner, or dependent child of such a member, may be entitled to an exemption from nonresident supplemental tuition if you fall into one of the following categories (A or B): A. Active duty member who is domiciled in California.
Domicile, for purposes of applying the federal law, is the one location where a person is considered to have the most settled and permanent connection; the place where they intend to remain; whenever temporarily absent, they have the intention of returning to. Evidence of domicile during the entire period of absence includes but is not limited to: Maintaining all legal ties to California (including driver’s license, vehicle registration, voter registration, filing California resident state tax returns and paying income taxes to the state of California) Maintaining a permanent address in California Listing California as the permanent state of residence (i.e. DD 2058 with the military) Listing California as the permanent state of residence on the most recent Leave and Earnings Statement.
B. Active duty member whose permanent duty station is in California.
Permanent duty station, for purposes of applying the federal law, is defined as the post of duty or official station to which a member of the Armed Forces is assigned or attached. A member of the Armed Forces assigned to a military base or installation in California would meet the requirements of having a permanent duty station in California. Evidence of permanent duty station includes: Official documentation from the commanding officer or personnel officer verifying that the military member is on active duty for a period of more than 30 days and whose permanent duty station is in California. If the active duty member is not domiciled in California or is not permanently stationed in California, the individual will be considered a non-resident for tuition purposes.
